Oh goody….looks like we may have a constitutional law battle on our hands……why?  It seems that Our Dear Supreme Leader has decided that he will try to make invalid parts of the US Constitution…..namely the 14th amendment…..

Whether President Trump can end birthright citizenship with an executive order comes down to one’s reading of the 14th Amendment. As NPR explains in a fact-check piece, a “small but vocal group of conservative legal scholars” have zeroed in on five crucial words, bolded here: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.” Those scholars say those words have been misinterpreted and that the authors’ true intention was that citizenship not be extended to the children of noncitizens.   • The Wall Street Journal’s editorial board agrees with NPR’s take and gives more historical background, writing “‘jurisdiction’ is well understood as referring to the territory where the force of law applies, and that means it applies to nearly everyone on US soil. The exceptions in 1868 were diplomats (who have sovereign immunity) and Native Americans on tribal lands. Congress later granted Native Americans birth citizenship while diminishing tribal sovereignty.”
  • On Twitter Wednesday, Trump referenced those key words in making his argument to the contrary. He wrote in a trio of tweets (here, here, and here): “So-called Birthright Citizenship, which costs our Country billions of dollars and is very unfair to our citizens, will be ended one way or the other. It is not covered by the 14th Amendment because of the words ‘subject to the jurisdiction thereof.’ Many legal scholars agree….. ….Harry Reid was right in 1993, before he and the Democrats went insane and started with the Open Borders (which brings massive Crime) ‘stuff.’ Don’t forget the nasty term Anchor Babies. I will keep our Country safe. This case will be settled by the United States Supreme Court! The World is using our laws to our detriment. They laugh at the Stupidity they see!”
  • Lawyer George Conway, husband to Kellyanne Conway, aired his view in an op-ed written with Neal Katyal for the Washington Post: “Sometimes the Constitution’s text is plain as day and bars what politicians seek to do. That’s the case with President Trump’s proposal to end ‘birthright citizenship’ tendment was written after the Civil War with former slaves in mind. Conway and Katyal elaborate in their op-ed: “Birthright citizenship sprang from the ashes of the worst Supreme Court decision in US history, Dred Scott v. Sandford, the 1857 decision that said that slaves, and the children of slaves, could not be citizens of the United States. The blood of hundreds of thousands of Americans was shed to repudiate that idea.”hrough an executive order.”
  • Reuters adds more history, reporting that the amendment was written after the Civil War with former slaves in mind. What Is Democracy?

Closing Thought–31Oct18

As we approach the Mid Terms this is a great question.  There are many of us that are questioning the fact that democracy is slipping away in this country (please do not give me the republic crap for you know what I am writing about)…..

This is a good conversation that answers (tries to answer) the question presented in the title…..

With our democracy in free fall, many are terrified, but I’m convinced that there is one thing with the power to turn the tide.

And what is that?

At the risk of sounding corny, or even ridiculous, I believe the one force with the power we need now is “falling in love with democracy.”  I know love can’t be forced, but I also know that to love we must first get acquainted. So, let’s ask, What, exactly, does democracy mean to us?  Is it worthy of our devotion?

That’s the conversation I long for and offer these thoughts as an invitation.

For some, the answer’s easy: Democracy equals a market plus elections.

First of all….that is a pathetic slogan!  America has always been great it just had to get its sh*t together in the early days….especially during the Revolution.

Just how radical was the American Revolution? Historians have debated that question for the better part of a century. A true consensus still escapes us. Nonetheless, the debate itself is instructive and tells us something of the nature of this experience.

No doubt, the American version of revolution lacks many of the standard symbols of radical revolution as we’ve come to perceive them, with neither the guillotines of France (1789-1794) nor the gulags and purges of Russia (1917-1923). Still, there was an 18th-century radicalism, all its own, to the American experience.

The war was won and now we needed to get to work on building a government for this fledgling country……onto the United States of America.

Where Did The GOP Go?

It is less than one week before the Mid-Terms are the big news of the day…..alright it has been news for a year now….but it will be balls to the walls very soon.

So I decided that I would do a series of posts on what is happening in this country as we approach the vote.

Many of us political obsevers have noticed the the GOP is a pale reflection of its past when it was a party of principles and few slogans….1950s, 60s and 70s and then the 80s and 90s arrived and the party started withering of the political vine…..

Republicans keep calling every national program – Socialism. They had been told to blame Democrats for social security, Medicaid and Medicare – all popular programs that they use and need. The inconvenient truth is that the entire world economy, controlled by the elite [aka SWAMP], is a Financial Socialist Order. The new Democrat Elite Financial Socialism has caused this global destruction, destroyed the old parties, made it so clouded with infiltration you couldn’t tell the difference between left and right – and failed to let their own party folks know – the good ol’ days are gone for the hypocrites too.

I was blessed to have known Congresswoman Marjorie Holt (1920 – 2007), a Maryland Congressional representative and a good friend of our family. Now more than ever, 40+ years later, I am proud to have been exposed to her awesome integrity. She stood up for what she believed in without caving to political pressures. Many times over the years, after I found her lone dove speech to Congress, I have mentioned that her sense of consequence was powerful.

A good study of what has happened and is happening to the GOP….

Personally, I think that it has nothing to offer but big business policies and big money solutions.

But if you want to send the GOP a message then boycott the Party…..

A few days after the Democratic electoral sweep this past November in Virginia, New Jersey, and elsewhere, The Washington Post asked a random Virginia man to explain his vote. The man, a marketing executive named Toren Beasley, replied that his calculus was simply to refuse to calculate. “It could have been Dr. Seuss or the Berenstain Bears on the ballot and I would have voted for them if they were a Democrat,” he said. “I might do more analyses in other years. But in this case, no. No one else gets any consideration because what’s going on with the Republicans—I’m talking about Trump and his cast of characters—is stupid, stupid, stupid. I can’t say stupid enough times.”

OOPS! There Goes The Constitution

It is not humorous to think that the Constitution can be dismantle by an idiot with a pen and a fist full of Executive Orders.

That is just what Our Dear Supreme Leader is trying to do with his newest brain fart…..

President Trump tells Axios that he plans to make a fundamental change to US citizenship rules: Babies born on American soil will no longer automatically be considered citizens. The president says he’s been advised by constitutional experts that he can make the change to what’s known as birthright citizenship through an executive order. “We’re the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States,” said Trump in an interview that airs in full on HBO this weekend. “It’s ridiculous. And it has to end.” (Actually, about 30 countries, including Canada, offer birthright citizenship.) The issue revolves around how the 14th Amendment is interpreted, and Axios notes that any such move by the president would be quickly challenged in court.

“It’s in the process,” said Trump. “It’ll happen … with an executive order.” The amendment states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.” The language has led to what critics call “birth tourism,” in which pregnant women enter the US for the express purpose of giving birth to attain citizenship for their child. In an interview with Fox News Monday night, Trump didn’t mention the executive order, but he said Central American migrants currently nearing the US border were “wasting their time.” Trump promised to erect “tent cities” on the border where any asylum seekers will be held while their legal case plays out. “We’re not catching, we’re not releasing,” he said. “We’re not letting them into this country.”

I wonder what the d/bags at the Federalist Society will have to say about this presidential brain fart?

Of course there are going to be those that think this announcement was made because the midterms are just days away…..

President Trump made big headlines Tuesday by revealing to Axios that he intends to end the practice of “birthright citizenship” with an executive order. Trump maintained that the idea of granting US citizenship to a newborn simply because the child was born on American soil is “ridiculous” and rejected the idea that he didn’t have the power to alter a protection cited in the Constitution.

How about the law for those like the President that have no damn idea on civics….The law: The 14th Amendment states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” USA Today explains that it was added in 1868, primarily to grant citizenship to freed slaves. (Legal aficionados can dig into this primer on relevant case law.)

Someone please take this president aside so he can stop embarrassing himself and the country.

2018–Where To Put My Vote

There are just a few days (One lousy week) before we vote and I have heard many people fret over where they can put their vote……(this may not help much in the Midterms but 2020 is coming)

There are many people, voters, that are not happy with the Democratic Party or the GOP and they have a decision as to where to put their vote.

We could always look to the parties of the past…Libertarians, Greens, Reform Party, Constitution Party and of course those on the far Right and Left…..or how about some of the up and coming parties…..

We are in the midst of a global crisis of democracy. As the foundations of the post-war international order are shaken, in part due to the real failures of existing American, European, and international institutions to address the needs of ordinary people, extreme right-wing movements are on the rise. In the United States, the radicalized Republican Party under Donald J. Trump is laying the foundation for a program dangerously reminiscent of fascism that we may refer to as Trumpism. These are the newest of the fledgling parties that deserve a shot at government for the traditional two have screwed the country so bad that it needs a new direction.

That Iraq War Study

After 14 years in Iraq the Pentagon has a study done on the war and what has been learned from the invasion and occupation….the problem is that it remains unpublished…and inquiring minds ask why?

It’s been praised by a number of top Army officials privy to it, and many think it’s a vital to make clear the lessons learned in the disastrous occupation of Iraq. But “The United States Army in the Iraq War” study remains unpublished, and may never see the light of day.

With officials citing the need to “relearn” many of the lessons of Vietnam at the start of the occupation of Iraq, Gen. Ray Odeirno commissioned the study in 2013. By 2015 it was completed, and had been compiled into a two-volume document.

Most Army officials on the record say it should be public, and some in Congress are also pushing for the completed document to finally be released. Yet there is a quiet resistance from senior leadership at the time, who are worried a report that declared the war “largely unsuccessful” will make them look bad.

The Army’s current position is that the study is “not an official history,” but that it would be published by the Army War College in the future. Whether it becomes publicly available then is uncertain, though it is clear that some simply prefer that the war’s failures remain unspoken.
