More Important Than The Trial

Closing Thought–21Jan20

The country is laser focused on the Senate impeachment trial but there are events that should be more important…why?

The trial will be a silly exercise in the absurd.

One of the “Rights” we have is the right to vote for who we like or better yet as a citizen I have the right to vote without worry…..

Back in the old Jim Crow days in the South Blacks had to pay a “poll tax” to vote….or they we not allowed to exercise a right……but thankfully those days are gone…..not so FAST!

Florida’s state Supreme Court on Thursday ruled in favor of denying convicted felons the right to vote if they do not pay fines and fees associated with their incarceration, a decision that was immediately assailed by rights activists as an unconstitutional and immoral poll tax.

In a statement condemning the ruling (pdf), the American Civil Liberties Union (ACLU), ACLU of Florida, Brennan Center for Justice at NYU School of Law and NAACP Legal Defense and Educational Fund said the ruling “does not—indeed, cannot—alter what the U.S. Constitution requires.”

“A federal court has already held that the state cannot deny people the right to vote because of their inability to pay financial obligations,” the groups said in their statement.

This is sick!

Trying to eliminate people from voting……

This will probably go to the US Supreme Court…as it should,,,,but I have NO confidence that this will be struck down by a mostly conservative court.

If not then this idea will spread throughout the South especially…..and the areas the the GOP has successfully purged voters from the rolls.

Senate Impeachment Trial Plan

History will be made today!

I really do not give a crap what you think of the president….this post is about the plan from the Senate……

Today begins the historic trial for the impeachment of the the president…..McConnell has set the plan for running this trial…..

Senate Majority Leader Mitch McConnell plans to seek a speedy impeachment trial of President Trump. In a Senate resolution released Monday evening, the AP reports, McConnell detailed the structure for the trial’s opening phase, with votes on witnesses deferred until next week. The resolution would permit Trump’s lawyers to move early on to win acquittal of the president and sets up a vote next week on calling witnesses. Below is the way the trial would go under McConnell’s plan.

First fight: McConnell’s resolution does not specifically allow for witnesses to testify, and Democrats promise to try to guarantee that witnesses, documents and other evidence are part of the trial. Any debate on these topics must be conducted in closed session under the Senate’s impeachment rules.

Initial motions: After the Senate adopts the organizing resolution, which will consume Tuesday, the legal teams for Trump and the House on Wednesday will be able to offer motions on housekeeping questions involving matters other than evidence or witnesses. In theory, Trump’s team could move to dismiss the case altogether.

Opening arguments: House impeachment managers will have 24 hours—packed into only two days—to make their opening arguments. The White House will have the same amount of time to respond, though Trump’s lawyers may not use it all.

Questions: Sixteen hours will be reserved for senators to ask questions of both legal teams. Those questions will be posed in writing through Chief Justice John Roberts, who will preside.

Witnesses: The issue of whether to call witnesses and which ones to call will be considered with up to four hours of argument by the White House and House Democrats. The Senate may go into closed session to debate further and then have a series of votes. If witnesses are called, they will be deposed before any potential live Senate testimony.

The verdict: After the Senate finishes deliberations, it will vote on the two impeachment articles, which requires a two-thirds vote to find Trump guilty and remove him from office.

There is the plan…..

I think there should be one minor adjustment…..all those Senators that went before the public and stated that they had already made up their minds should recuse themselves for violating the oath and the rules of a fair trial.

I will be giving a running tally of the trial……

Historic Impeachment Begins!

Just a quick look at the process……(please comment on the process not the popularity of the accused)…..

Just a short reminder of what a fair and impartial process will look like…..

Article I of the Constitution grants the House the sole power of impeachment, and if the House does impeach, the Senate the “sole power to try all impeachments.” It also provides that the Chief Justice of the U.S. Supreme Court will preside if the trial involves a president. The Constitution authorizes the Senate to “determine the rules of its proceedings,” including additional rules governing an impeachment trial by the Senate. The Senate has established and may modify its own rules supplementing these constitutional requirements.

Four principles for conducting a full, transparent, and fair impeachment trial:

  • Trial procedures should be established before the trial commences. A trial can only be fair if the rules are agreed to in advance. For that reason, any supplemental rules or modifications to the existing rules should be agreed to before the trial commences.
  • The Senate should hear the full case before voting on the President’s removal. The Senate must allow members of the House to present the case for the President’s removal and the President should be afforded an opportunity to respond. Both should occur before a vote to dispose of or approve an article of impeachment.
  • The trial should be open to the public. An impeachment trial of a president is a matter of exceptional importance to the American people. They should be able to understand the case for the President’s removal and the President’s defense. The doors to the Senate chamber should be open and the American people permitted to witness the proceedings to the extent possible. Transparency should only be sacrificed to advance compelling interests such as the sanctity of Senate deliberations, the need to protect legitimately classified information, or the recognition of a whistleblower’s right to anonymity.
  • Each Senator should take seriously his or her oath to “do impartial justice” and to “support and defend the Constitution.” The question is not whether to support the President. The question is whether the President has committed treason, bribery, or other high crimes and misdemeanors within the meaning of the Constitution.

How a Fair, Transparent Impeachment Trial Should Proceed

If you truly want a fair and transparent trial then the recusal of any and all Senators from the juror pool for statements made that their mind is made up before the trial and anyone that has stated that they are in contact with the accused for coordination.  That would be Sens. Graham, Kennedy, McConnell et al….these Senators violated Nos. 2 & 4……

Like anyone really cares about the process…..it is much easier to rant and moan about how it appears not the legality.

This process will be a circus and the Senate will be the clowns for our entertainment.

War–Invest Your Children

There is an old saying….”Old men start wars and young men fight them”……and then Sartre said “when the rich wage war it is the poor that die”……”War settles nothing!”

There has been a lot of reports about the possibility of a new war for us Americans to fight and die.

I see the warmongers thumping their chest in wild blood lust…and yet as many wars as we are fighting today I see very little of people in opposition to war.

The young should be listening to all the war rhetoric and listening closely…..for they will be called upon to fight the “good fight”….

America’s forever wars and their fallout over these last 18 years have been hell for kids. Just ask Ismail or any of the other 56 wounded children who survived an August 2018 attack on their school bus in northern Yemen by Saudi planes armed with American weaponry. Of course, you can’t ask the perhaps 40 children who died, thanks to a single 500-pound laser-guided MK 82 bomb made by Lockheed Martin. And that was just one example of the way, in these years, war has torn the lives of children apart across the Greater Middle East.

Take, for example, Iraqi children in a country remade (or, more accurately, devastated) by the U.S. invasion of 2003 and everything that followed from it, including the ISIS takeover of major Iraqi cities in 2014. By 2016, UNICEF reported that “one in every five children in Iraq is at serious risk of death, injury, sexual violence, and recruitment into armed groups.” That was 3.6 million children (a jump of 1.3 million in 18 months). And if you make your focus larger still, UNICEF recently reported that, thanks to largely war-induced humanitarian crises across the Middle East and northern Africa, 32 million children need assistance, 5.8 million of whom are refugees.

How War Targets the Young

I have written about the shortcomings in our volunteer military……the young needs to pay attention…..

Show me a better deal for the common person,” he said.

Soldiers like him are increasingly making the United States military a family business. The men and women who sign up overwhelmingly come from counties in the South and a scattering of communities at the gates of military bases like Colorado Springs, which sits next to Fort Carson and several Air Force installations, and where the tradition of military service is deeply ingrained.

More and more, new recruits are the children of old recruits. In 2019, 79 percent of Army recruits reported having a family member who served. For nearly 30 percent, it was a parent — a striking point in a nation where less than 1 percent of the population serves in the military.

Here’s a thought for Millennials……pay attention and you will not be surprised…..but I guess for that to sink in I need to be on some sort of social media and have no life…..
