I Now Pronounce You……..

For decades there has been a battle raging over the simple act of getting married…….we have heard from the Leftist…..then the religious d/bags that equate same sex marriage with everything from incest to bestiality….and then there were those like myself that felt that it was a personal and private decision made by two people and because it was thusly it was none of my business or anyone else for that matter……..

Like I said we have heard from everybody and now we have heard from the the last player………. SCOTUS………

Perhaps the most anticipated Supreme Court case has been decided, and it’s a yes for same-sex marriage throughout the land. In a ruling authored by Justice Anthony Kennedy, the court voted 5-4 today that states cannot ban same-sex marriage, the AP reports.
Kennedy wrote that gays and lesbians “may not be deprived of liberty” or of that “fundamental right” to marry, per CNN. Gay couples could already marry in 36 states and DC, but now the other 14 states will no longer be able to ban same-sex couples from doing so. The decision reveals the court’s resounding “yes” to one of the most important constitutional questions posed in recent times, as worded by the Wall Street Journal in January: “Does the 14th Amendment, which guarantees ‘equal protection’ and ‘due process’ of law, forbid states from treating gay couples differently than heterosexual ones?”

The opinion seems to purposely not state a “standard of scrutiny,” SCOTUSblog notes. Instead, it asserts “it is now clear that the challenged laws burden the liberty of same-sex couples, and it must be further acknowledged that they abridge central precepts of equality. … This denial to same-sex couples of the right to marry works a grave and continuing harm.” President Obama sent out a tweet right after the ruling was announced, writing, “Today is a big step in our march toward equality. Gay and lesbian couples now have the right to marry, just like anyone else

Of course the battles are not over…….the state’s rights jerks will be looking for ways to circumvent the ruling as they have with abortion….

For now it is a win for equality…..and after all is that not what the Founders intended?

The Question Of Marriage

All the rage on Twitter, in blogs and in the news is the question of marriage…..most notably that of same sex marriage.  But all this back and forth, the proclamations of doom and the sheer amount of lunacy around the subject.

I have not posted much on this for this is none of my business who a person marries……it is a commitment by two people to each other……and in that it is a personal and a private decision that NO one should have a say other than the two people.

Have I made myself clear?

But the subject of marriage peaked my interests and I did some surfing in the more radical, looney tunes Right wing blogs on the subject……I just wanted to see just how ignorant these morons can be.

I eventually found a subject that I felt passionate about….interracial marriage and how it was at one time illegal in certain states, most of whom were in the South.

But first a little background…..I am a product of an interracial marriage…..my father was white and mother was Native American, Apache to be exact.  My daughter is the product of an interracial marriage……her mother is Thai.

With all that said I will continue this thought……when I was working for the state housing authority we were always dealing with people of interracial marriages and at one point one of my co-workers and and with a little participation from a couple of other workers were talking about this situation…..my co-worker was against it because he said it was difficult to decide which culture the child should be raised in…….I let him talk and quote the Bible (I guess) and then I said that is would be a simple decision.  He looked at me roughly and said how so?

I would raise my interracial child as an American.

The debate ended about there.

Okay all that background stuff out of the way……I found a site where these people were almost violently opposed to interracial marriage…..they want to go back to the days of Jim Crow….one even quoted the judge in the Living v Virginia…..a mixed race couple that were being persecuted for being married……

At the age of 18, Mildred became pregnant, and in June 1958 the couple traveled to Washington, D.C. to marry, thereby evading Virginia’s Racial Integrity Act of 1924, which made interracial marriage a crime. They returned to the small town of Central Point, Virginia. Based on an anonymous tip,[8] local police raided their home at night, hoping to find them having sex, which was also a crime according to Virginia law. When the officers found the Lovings sleeping in their bed, Mildred pointed out their marriage certificate on the bedroom wall. That certificate became the evidence for the criminal charge of “cohabiting as man and wife, against the peace and dignity of the Commonwealth” that was brought against them.

The Lovings were charged under Section 20-58 of the Virginia Code, which prohibited interracial couples from being married out of state and then returning to Virginia, and Section 20-59, which classified miscegenation as a felony, punishable by a prison sentence of between one and five years. The trial judge in the case, Leon M. Bazile, echoing Johann Friedrich Blumenbach‘s 18th-century interpretation of race, wrote:

Almighty God created the races white, black, yellow, malay and red, and he placed them on separate continents. And but for the interference with his arrangement there would be no cause for such marriages. The fact that he separated the races shows that he did not intend for the races to mix.

On January 6, 1959, the Lovings pleaded guilty and were sentenced to one year in prison, with the sentence suspended for 25 years on condition that the couple leave the state of Virginia. They did so, moving to the District of Columbia.

The site I was on was this old fart racist that said that the judge’s statement should be the RULE of the land……of course I could not let that go without voicing an opinion……

I explained to him my ancestry and said……If we are to live by that statement then it is time for…..ALL YOU HONKIES GO HOME!

Backing Up Without The Warning Sounds

I do not usually post on religious stuff because I really do not care…religion has been used to suppress more human activity than just about any other issue…..but yesterday the Pope made history and yes it was notable.

The whole world was thrilled when the Pope came out and addressed same sex marriage…there was a rush to pat him on the back….few stop to think about what he said is NOT binding in any way….

Guess what the day after his ground breaking statement and the Catholics have hit the reverse gear…..

(Newser) – The Vatican made waves this week with a seemingly more open stance toward gay and divorced people—but now, Catholic officials are pulling back from Monday’s statement amid a backlash from conservatives, CNN reports. The Vatican’s earlier comment that “homosexuals have gifts and qualities to offer to the Christian community” isn’t its official stance, it emphasized in a follow-up statement yesterday; instead, it’s simply part of a “working document.” Even as it seeks a more welcoming approach to the issue, the church doesn’t want to give “the impression of a positive evaluation” of same-sex relationships.

“The same care was advised with regard to cohabitation,” the Vatican added, following comments that called for acknowledgment of the “positive” elements of unmarried couples living together. Monday’s comments reflect issues to be debated at the synod ahead of a final statement, leaders say, as per the Independent. One cardinal blasted Monday’s comments as “irredeemable,” CNN notes. “It’s not what we’re saying at all,” says South Africa’s Cardinal Wilfrid Fox Napier. But liberal Catholics still see a breakthrough: “Regardless of the fact that this is a working document, it is still significant in that it reveals a strong current of affirmative attitudes at high levels in the church towards lesbians and gay people,” says a leader of the New Ways Ministry.

This is what I expected when I heard the Pope’s statement……as usual with anything religious their concern was too good to be true…..

During this time of the menstrual cycle we call democracy many things are said and many of those could be considered an anal statement……and one of the most anal is one, Rick Santorum….he has said many things but I could not decide which needed to be immortalized…..until I heard this….when giving a speech he was asked about the decision on Prop 8…….

Ninth Circuit Court of Appeal’s decision striking down Proposition 8— accused the administration of “crushing” religion and setting the United States on the path towards executing religious people by decapitation:

SANTORUM: They are taking faith and crushing it. Why? Why? When you marginalize faith in America, when you remove the pillar of God-given rights, then what’s left is the French Revolution. What’s left is the government that gives you right, what’s left are no unalienable rights, what’s left is a government that will tell you who you are, what you’ll do and when you’ll do it. What’s left in France became the guillotine.Ladies and gentlemen, we’re a long way from that, but if we do and follow the path of President Obama and his overt hostility to faith in America, then we are headed down that road.

I would like to interject something into this….but why?  Santorum did it for me…….

2011 Anal-Ocity #19

OK, we off and running….give a politician a platform and he will say some really moronic stuff….and then give him a microphone and a way we go….anal statement after anal statement….

Yep, gays are on the news again….first it was DADT and now it is the DOMA…when the fiscal policy should be foremost on the minds of ALL politicians we get social issues on top of social issues…ranting and raving about abortions or marriage or whatever drives their petite thoughts….

The new anal statement is from Texas Repub, Lamar Smith…..when discussing DOMA he said……

“No one can seriously believe that the constitution’s authors intended to create a right to same-sex marriage,”

My readers know that whenever a politician invokes the Founders I have to say something…..Smith does NOT speak for the Founders….none of these so-called constitutionalists do……if anyone needs to weigh in (not saying they do) it should be the Supreme Court…but that aside my opinion is just as valid as Smith (he may make more cash off of corporations than I) but our opinions are of equal weight…..and I think the Founders did not think about any of this they had much more important things to worry about like the start of a new country….maybe Smith and his band of crazies need to keep that in mind and start working on the continuation of the country of the Founders….Just a thought!

Prop 8 Goes To SCOTUS

Meanwhile…back at the Constitution………

Prop 8 for those who may have been under a rock looking for the representative is that same sex marriage ballot initiative in California that would have not allowed same sex partners to wed….well, it seems that a federal judge has thrown out the prop 8results and has set up a showdown on same sex marriage in the Supreme Court this Fall…..

First of all, I want to say that I do not normally comment on things of a moral nature because it is none of my business….what people do in the privacy of their home is none of my business and definitively none of the government’s business…..but I will make an exception this time because we will be dealing with the Constitution of the United States….

Basically this is what Judge Walker had to say about the ban on same sex marriage:

Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples. Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis, the court concludes that Proposition 8 is unconstitutional.

Unconstitutional?  This is the issue that will send this to the Supreme Court….the constitutionality of the ban.

It seems you cannot make a ruling that does not apply to all Americans….it is called equal protection under the law…..and the states that have passed referendums on banning same sex marriage could be struck down because state law cannot undermine federal law……

And yes it will be a civil rights thing……not to compare it to the marches of the 1960’s….I am referring to the concept of denies rights to a group of Americans in favor of another group…….and again “equal protection under the law”……

It will be fascinating to see how this will play out in the Supreme Court….will the referees of our political system use the rules and laws of the country to settle a dispute or will they do what they are accused of doing…..being activists and disregard the Constitution?
