This is right time for the Old Professor to drop a bit of history on you that tries to enlighten the reader to the history that is all too forgotten.

Little Donny is deporting people at an alarming right all in an effort to keep the loyal in line with his brand of ignorance…..so far this year…Within the span of 100 days, the results of this sweeping and sustained set of actions, touching nearly every corner of the U.S. immigration system, have yielded some quick results. U.S. Border Patrol encounters of irregularly arriving migrants at the U.S.-Mexico border plunged to 7,000 in March—the fewest since at least 2000, when the government started publishing monthly apprehension numbers—after the administration declared an “invasion,” sent 10,000 troops to the border, and effectively barred access to asylum there.

All these deportations is a first for a president, right?

Not even close.

Just another misguided attempt to appear as if he truly cares about this country.

Before I go on maybe it would be a good spot to drop some history about the ‘law’ that the Trumpites are using to justify these deportation….even though the justification for these deportations is the ancient act from the 18th century….about here would be a good time to explain the “Act” for the history impaired….

The Alien Enemies Act of 1798 is a wartime authority that allows the president to detain or deport the natives and citizens of an enemy nation. The law permits the president to target these immigrants without a hearing and based only on their country of birth or citizenship. Although the law was enacted to prevent foreign espionage and sabotage in wartime, it can be — and has been — wielded against immigrants who have done nothing wrong, have evinced no signs of disloyalty, and are lawfully present in the United States. It is an overbroad authority that may violate constitutional rights in wartime and is subject to abuse in peacetime.

… but the mass deportations occurred in the beginning of the middle 19th century and the Chinese immigrants.

The United States’ current deportation process traces its roots to the late 19th century as the nation moved to exercise federal control of immigration.

The impetus for this shift was anti-Chinese racism, which reached a fever pitch during this period, culminating in the passage of laws that restricted Chinese immigration.

The influx of Chinese immigrants to the West Coast during the mid-to-late 19th century, initially fueled by the California Gold Rush, spurred the rise of an influential nativist movement that accused Chinese immigrants of stealing jobs. It also claimed that they posed a cultural threat to American society due to their racial otherness.

The Geary Act of 1892 required Chinese living in the U.S to register with the federal government or face deportation.

The Supreme Court addressed the constitutionality of these statutes in 1893 in the case of Fong Yue Ting v. United States. Three plaintiffs claimed that anti-Chinese legislation was discriminatory, violated constitutional protections prohibiting unreasonable search and seizure, and contravened due process and equal protection guarantees.

The Supreme Court affirmed the Geary Act’s deportation procedures, formulating a novel legal precept known as the plenary power doctrine that remains a key tenet of U.S. immigration law today.

Is Donny’s use of ‘Act’ legal by Executive Order?  Damn good question!

… no court has expressly interpreted “invasion” in the context of the AEA, the definition of “invasion” in the constitutional sense has received recent judicial and scholarly attention. Early last year, Texas tried to make the immigration-as-invasion argument in two cases, United States v. Texas and United States v. Abbott, the former of which dealt most directly with the claim. There, a district court—after providing one of the most comprehensive analyses of “invasion” in the State War Clause—enjoined the enforcement of Texas law that established state criminal liability for immigration law violations. Although the U.S. Court of Appeals for the Fifth Circuit ultimately stayed the injunction, it was “not persuaded” by Texas’s immigration-as-invasion argument. The case is still pending. In light of interpretative uncertainty, recourse might also be had to interpretations of the president’s unilateral authority to use force to repel attacks or invasions.

This will be a sticky situation for only recently a Trump appointed judge rules against Donny’s move on Venezuelans.

A federal judge on Thursday barred the Trump administration from deporting any Venezuelans from South Texas under an 18th-century wartime law and said President Trump’s invocation of it was “unlawful.” US District Court Judge Fernando Rodriguez Jr. is the first judge to rule that the Alien Enemies Act cannot be used against people the administration claims are gang members invading the United States, the AP reports.

  • “Neither the Court nor the parties question that the Executive Branch can direct the detention and removal of aliens who engage in criminal activity in the United States,” wrote Rodriguez, who was nominated by Trump in 2018. But, the judge said, “the President’s invocation of the AEA through the Proclamation … is contrary to the plain, ordinary meaning of the statute’s terms.”
  • Rodriguez’s ruling is significant because it is the first formal permanent injunction against the administration using the AEA and contends the president is misusing the law, the AP reports. “Congress never meant for this law to be used in this manner,” said Lee Gelernt, the ACLU lawyer who argued the case, in response to the ruling.
  • If the administration appeals, it would go first to the New Orleans-based 5th US Circuit Court of Appeals, one of the nation’s most conservative appeals courts. The Supreme Court has already weighed in once on the issue of deportations under the AEA. The justices held that migrants alleged to be gang members must be given “reasonable time” to contest their removal from the country. The court has not specified the length of time

This whole debacle will be interesting to watch….and I will watch.

Waiting On A ‘Gold Card’

This is not the same thing as your Visa gold card….this is in reference to the US visa that the Trump Administration is selling….you are surely heard the term ‘green card’…..well this is a visa that rich people can pay to enter the US.

President Trump teased a new visa program Tuesday with something “like a green card,” but his favorite color: gold. Trump said the gold card, with “a higher level of sophistication,” would offer “very high-level people” a new “route to citizenship”—for the cost of $5 million, per the New York Times. “Wealthy people will be coming into our country by buying this card” and receiving “green card privileges,” said Trump, who spoke to reporters while signing various executive orders, per CNN.

Commerce Secretary Howard Lutnick said “the Trump gold card” would replace the EB-5 visa program, under which investors and their families can receive permanent residence if they make a significant investment in a US business that creates or preserves 10 permanent full-time jobs for US workers. Trump said the wealthy foreigners buying gold cards would be “people that create jobs,” without giving details, per the Times.

“They’ll have to go through vetting, of course,” Lutnick said, per CNN, “to make sure they’re wonderful world-class global citizens.” Asked if a Russian oligarch would be eligible, Trump replied, “Yeah, possibly. I know some Russian oligarchs that are nice people.” “I think they can afford $5 million,” he continued. He predicted the government would be able to sell a million or more gold cards starting in about two weeks. “If you add up the numbers, they’re pretty good,” he said.

A new way for the rich to come here and become a parasite on the American system.

President Donald Trump believes he can pay off America’s $36 trillion national debt by charging rich immigrants $5 million for a gold card—which has green card privileges “plus a route to citizenship.”

President Trump made the impromptu announcement in the Oval Office yesterday, telling reporters: “Remember the words gold card.”

The president said he had planned to make the announcement next week but seized the opportunity to share the news while signing executive orders on Tuesday.

As a result, details of what the gold card will entail are still sparse, but the Republican politician said: “Wealthy people will be coming into our country by buying this card. They’ll be wealthy and they’ll be spending a lot of money and paying a lot of taxes and employing a lot of people.

They will come and pay lots of taxes……who believes that fairy tale?

We are well aware that the GOP and its mouthpiece, Trump, have this burning desire to punish people with brown skin and his newest intent has people scratching their heads….

What has them confused?  The term ‘remigration’.

But one part of the GOP nominee’s weekend post stood out. “[We will] return Kamala’s illegal migrants to their home countries (also known as remigration),” Trump wrote. Former White House senior adviser Stephen Miller reposted it, saying “THE TRUMP PLAN TO END THE INVASION OF SMALL TOWN AMERICA: REMIGRATION!”

What did Trump and Miller mean by “remigration”? Even seasoned immigration policy analysts had to look the term up:

“Remigration,” as a 2019 article about the rise of extreme anti-immigrant language in Europe from the Associated Press explains, is the “chilling notion of returning immigrants to their native lands in what amounts to a soft-style ethnic cleansing.” The word stands in for a policy that entails the forced repatriation or mass expulsion of non–ethnically European immigrants and their descendants, regardless of citizenship. With little fanfare, Trump seems to be hinting at bringing an even more radical idea into his immigration proposals (to Miller’s all-capped cheers) that goes further than the mass deportation of the undocumented population.

Will I Be Deported?

That is probably the main question on immigrants minds these days.

But should it be on the minds of citizens?

It appears that Trump made a comment about deporting American citizens during one of his recent campaign stops…..

Donald Trump hosted back-to-back rallies in two states on Tuesday, using his time to attack President Joe Biden’s immigration policies and make some extreme promises in regard to his own agenda for the U.S.-Mexico border. That included claiming he’d deport U.S. citizens if undocumented migrants were found “invading” their homes.

“If your constitutional rights have been violated, we will defend you. If you have illegal aliens invading your home, we will deport you,” Trump said during an event in Wisconsin, his second stop of the night.

The claim, which is alarmingly similar to the policies of another far-right leader who punished civilians for hiding Jews in their homes, could be a direct attack on a controversial program announced last month by Michigan Governor Gretchen Whitmer’s administration. Whitmer’s new policy offers $500 subsidies for households that volunteered to shelter refugees.

Or, if the phrasing was just another verbal gaffe, it would add to a mountain of evidence that Trump is losing his grip. Over the last several months, Trump has claimed that there were “millions of people” arriving from “places unknown” speaking no language and that he would stop banks from “debanking” Americans; he has mixed up former House Speaker Nancy Pelosi and former South Carolina Governor Nikki Haley and described his plan for America’s missile defense system by going, “Ding, ding, ding, ding, ding, ding.… Boom. OK. Missile launch. Woosh. Boom.”

Senate Border Deal

The biggest story so far this year has been the crisis on our Southern border and this problem is giving the GOP lots of false support in the upcoming election cycle.

A Senate committee has come together giving a bi-partisan approach to this situation….a deal, in my opinion, stinks.

Senators on Sunday released a highly anticipated $118 billion package that pairs border enforcement policy with wartime aid for Ukraine, Israel, and other US allies, setting off a long-shot effort to push the bill through heavy skepticism from Republicans, including House Speaker Mike Johnson, the AP reports. The proposal could be the best chance for President Joe Biden to resupply Ukraine with wartime aid—a major foreign policy goal that is shared with both the Senate’s top Democrat, Sen. Chuck Schumer, and top Republican, Sen. Mitch McConnell. It is still unclear if the bill will pass in the Senate, which is expected this week to hold a key test vote on the legislation, but it faces a wall of opposition from conservatives.

With Congress stalled on approving $60 billion in Ukraine aid, the US has halted shipments of ammunition and missiles to Kyiv, leaving Ukrainian soldiers outgunned as they try to beat back Russia’s invasion. Biden said in a statement that the Senate proposal “allows the United States to continue our vital work, together with partners all around the world, to stand up for Ukraine’s freedom and support its ability to defend itself against Russia’s aggression.” And on the border, Biden said that the immigration system has been broken for too long, and it’s time to fix it. “It will make our country safer, make our border more secure, treat people fairly and humanely while preserving legal immigration, consistent with our values as a nation,” Biden said.

The new bill would also invest in US defense manufacturing, send $14 billion in military aid to Israel, steer nearly $5 billion to allies in the Asia-Pacific, and provide humanitarian assistance to civilians caught in conflicts in Ukraine and Gaza. In a call with reporters after releasing the legislation, Schumer said he has never worked so closely with McConnell. He called the bill a “monumental step” toward strengthening national security at home and abroad. McConnell said in a statement that the Senate must be “prepared to act.” In a bid to overcome opposition from House Republicans, McConnell had insisted last year that border policy changes be included in the national security funding package. More on those changes, resistance to the bill on both sides, plus a potential House bill some senators prefer, here.

The Senate bill would authorize $60 billion to spend on the proxy war in Ukraine and $4.8 billion to “support key regional partners in the Indo-Pacific,” a portion of which will go toward replenishing arms sent to Taiwan.

The bill also provides $2.44 billion to US Central Command and to “address combat expenditures related to the conflict in the Red Sea,” where US naval forces have been bombing Yemen and downing Houthi drones and missiles. Since January 12, the US has bombed Yemen at least 16 times, and the situation in the region continues to escalate as the Houthis are not backing down.

I think this bill is dead on arrival in the House….but that is not why I think it sucks.

The bill should be about the situation on the border and none of it should be trying to sneak cash in for these proxy wars we keep fighting.

Those situations should be handled by a stand alone bill not masked by some perceived problem elsewhere.

If our Congress cannot find the cash for these wars then it is time to say f*ck it and move on to other situations that need attention.

But we have not heard the last of the border or the blood money for Israel and Ukraine.

Those Damn Open Borders

I am sick of these ‘people’ that keep harping on the Biden policy of open borders…..it is total fantasy.

In reality there is very little difference between Biden’s policies and that of his opponent, Trump, when he was president.

But no one wants to look at the stats it is so much easier to whine about the borders and believe the total manure spread by conservatives and ignorant Dems.

Here is something the conservs and their butt buddies will not tell you….

According to new data published last month, the Biden Department of Homeland Security (DHS) has removed a higher percentage of arrested border crossers in its first two years than the Trump DHS did over its last two years. Moreover, migrants were more likely to be released after a border arrest under President Trump than under President Biden.

In absolute terms, the Biden DHS is removing 3.5 times as many people per month as the Trump DHS did. These figures are important for understanding how each administration has carried out border enforcement

During the Trump administration, DHS made 1.4 million arrests—what it calls “encounters”—in fiscal years 2019 and 2020 (24 months). Of those people arrested, only 47 percent were removed as of December 31, 2021, which includes people arrested by Trump and removed by Biden, and 52 percent were released into the United States.

Under Biden, DHS made over 5 million arrests in its first 26.3 months, and it removed nearly 2.6 million—51 percent—while releasing only 49 percent. In other words, the Trump DHS removed a minority of those arrested while the Biden DHS removed a majority. Biden managed to increase the removal share while also increasing the total removals by a factor of 3.5

Send In The Calvary

Florida’s mini dictator, DeSantis, has been waging war in his state…war on bathrooms, education, rights, voters, Disney and now he is exporting his ‘jack boots’ to the border.

Florida Gov. Ron DeSantis says he’s sending a formidable force, including planes, boats, drones, and more than 1,100 personnel, to help “defend” the border with Mexico. The Republican, who is expected to announce a White House bid within weeks, said the deployment will include 800 members of the Florida National Guard, 200 agents from the state Department of Law Enforcement, 101 state highway patrol troopers, and 20 agents from other state agencies, NBC reports. DeSantis sent around 100 law enforcement officers to the border in a similar move in 2021.

DeSantis said the personnel are being sent to the border for 30 days but extensions are possible. He cited the end of COVID-era Title 42 restrictions at the border, though the change last week was not immediately followed by the expected surge in migrants. “While Biden ignores the crisis he created, Florida stands ready to help Texas respond to this crisis,” he said, per the Hill. Texas Gov. Greg Abbott said Tuesday that he had asked governors to help the state with its “unprecedented border security efforts.” He said DeSantis and Idaho Gov. Brad Little had already offered resources.

“Given the crisis at the border, we decided to send in the cavalry,” said Taryn Fenske, the governor’s communications director. Some of the governor’s critics called the move a “political stunt,” the Miami Herald reports. “What an irresponsible waste of critical state resources by DeSantis for his own performative national politics,” tweeted former GOP Rep. David Jolly.

The problem they are trying to ‘solve’ may be a moot point….for after the crush of immigrants to the border with the end of 42 the amount of immigrants has fallen by 50%.

Here is a thought maybe Texas should spend more time with the border policies and less time fighting individual rights and education and all the other diversions.

But the GOP needs immigrants for it is a rallying point for all the hatred and  is doing nothing to move Texas into the 21st century.

Now What?

First let me say…..I think we are did a marvelous thing helping Afghans and their exodus from the Taleban and the plight to come.

Roughly 88,000 people who worked for the US government during the war, as well as their family members, are in the application pipeline for special immigrant visas (SIVs). Some are being sent to other countries to wait; others who are further along in the process are being sent to the US directly for resettlement.

There are also many thousands more who aren’t eligible for those visas but who might try to apply for refugee status through a recently created US priority program. But they will have to stay in third countries — where they will need financial support, among other kinds of aid — for months while they are being processed. US vetting requirements, capacity limitations at refugee resettlement agencies, and a finite number of slots available under the current refugee admissions cap could all contribute to delays in bringing them to American soil.

Just me thinking out loud.

The exodus from Afghanistan has been a humanitarian crisis in warp speed….the refugees are being relocated to Qatar, Germany, Mexico, the US and several other counties….we have seen all this before.

Think 1970s….Think Vietnamese ‘Boat People’…..

Now that we are relocating these people….what we saved them from will create more misery for them in the long run…..I fear.

What will their lives become?

I will use my region as an example….I have no indication of other areas to compare my thoughts with…..

When the Boat People started arriving some were given confiscated fishing and shrimp boats that had been ceased by the Coast Guard….since my region at one time was dependent on seafood as a way of life…this way the new arrivals could earn a living and become a functioning member of society.

This irritated the locals that were already struggling with a diminishing source of income.

The new arrivals caused many violent skirmishes with the locals….the biggest bitch they had was that the Vietnamese trolled the bottom and did not throw back anything that was not the harvest they searched for…..

The new arrivals were not accepted into Gulf Coast society and they set up areas that have become known as “Little Saigon”…..they became a society unto themselves…..it took a generation or more for that to change and yet not much has changed within the area unknown as “Little Saigon”.

Is this the new norm for the entering Afghan refugees?

Refugees are being accepted by poorer countries that are struggling to assist their indigenous people….so how will this improve the lives of people fleeing Afghanistan?

From what are we saving these people?

Some reports state that the US will take around 50,000 refugees….

Up to 50,000 Afghans could be arriving in the U.S. under a rarely used humanitarian program that allows people to enter the country without visas.

Refugee resettlement agencies were told to prepare to receive as many as 50,000 Afghans arriving on “humanitarian parole” in a meeting with government officials last week, Jenny Yang, a senior vice president of advocacy and policy at World Relief, told Newsweek.

The ‘exit’ helps generate ratings boons….then the next phase will do the same.

We are entering a dangerous time for the new arrivals…..and the news will trot out new ‘experts’ once the generals and other pundits have grown hoarse from bitch and analyzing the ‘exit’.

The question remains……But what now?

One Republican lawmaker on Tuesday ratcheted up the rhetoric of fear about Afghan refugees and said that accepting them into the United States will endanger Americans.

Rep. Scott Perry (R-PA) was asked by Greta Van Susteren on her “Full Court Press” show why he voted against the ALLIES Act, which was a bipartisan effort to help get Afghan military partners and their families to safety in the United States.

“Because I don’t think it’s appropriate to bring poorly vetted people from an Islamic state to the United States of America,” he said. “I represent the United States of America and American citizens, and it’s my job and I think it’s this Congress’s job to ensure their safety.”

DACA Saved! (For Now)

We all know how much the Trumpian thugs hate immigrants and has been trying to end the DACA program….and their latest attack on immigrants has gone down in defeat….as it should…..

Looks like DACA was wrongly suspended this summer because the acting Homeland Security chief didn’t belong there—at least not in the eyes of the law, NBC News reports. Judge Nicholas Garaufis ruled Saturday that Chad Wolf, acting Homeland Security secretary, “was not lawfully serving” in the role when he suspended the so-called “Dream Act” in July. The Obama-era program protects migrants brought illegally to the US as children. The Garaufis ruling means “the effort in the Wolf memo to gut the DACA program is overturned,” said a lawyer involved in the case. “This is really a hopeful day for a lot of young people across the country.”

Garaufis explained that when former DHS Secretary Kirstjen Nielsen stepped down, she was replaced by Kevin McAleenan even though he wasn’t authorized to do so, per Law & Crime. That means McAleenan’s delegation of the position to Wolf was not “authorized” and Wolf’s suspension of DACA “was not an exercise of legal authority,” the judge said. Wolf made the move after the US Supreme Court blocked a Trump administration effort to terminate the program. CBS News reports that the ruling affects hundreds of thousands of people who can be shielded from deportation by DACA. CNN reports that the US government can appeal the ruling.

You realize that they use that immigrants are a drain on our resources and country…..well that may not be true at all….

The administration has said that refugees – those forced to leave their country to escape war or persecution – do not benefit the U.S. economy. It has portrayed refugees as a drain on resources and argued that a lower number of refugees is required to prioritize the well-being of Americans.

This feeds into the perception among some Americans that immigrants come to this country and either take their jobs or do not work at all and live off of welfare. Both those ideas are false.

In my research, I have found that refugees are far from an economic drain. They are quick to integrate into local economies. And nationally they have high labor force participation rates, which includes people who are employed or looking for employment.

America has a long history of people bitching about all those immigrants….about the Chinese, Irish, Italian, Cuban, Vietnamese, on and on…there is nothing really special about the “dislike” of immigrants.   Trump was not the first and I am sure that he will not be the last bigot in office.

But can we point to the first Trump-esque American in our society?

Yes we can….and his name was….Lewis Charles Levin in Philadelphia…..the year is 1844……and the movement has been simmering for over 150 years……

On a stormy Monday afternoon in the spring of 1844, a stout, well-built, 35-year-old Philadelphia newspaper editor ascended a makeshift podium assembled from a stack of packing boxes. Surrounded by some three thousand of his fervent supporters – butchers, grocers, carpenters and craftsman, many armed for this occasion – Lewis Charles Levin had come to the main market in Philly’s heavily Irish-Catholic neighborhood of Kensington. He was there to rail against the rising tide of Catholic immigrants taking jobs from proud Pennsylvania-born Protestants, and the resulting “consequence upon American liberty” he vowed would surely come of admitting even more foreigners.

Levin was a son of immigrant Jew from England…..

Levin was born on Nov. 10, 1808, in Charleston, South Carolina, to parents who had immigrated from England. Charleston was then home to about 700 Jews, which was enough to make it the largest community of Jews in the United States.

Over the next 30 years, Levin pursued at least three careers in at least five states, maybe more. He spent two years in Columbia, South Carolina, attending college and running a dry goods store. He next became a schoolmaster, starting one school in Cincinnati, and then, a year later, another one in Woodville, Mississippi. He next moved to Vicksburg, then Nashville, then Baltimore, probably with sojourns in Kentucky and Louisiana as well. Along the way he learned enough law to call himself “L. C. Levin, Esq.,” though what legal training he received, and even what bars admitted him, remain obscure.

Probably Levin is best known for being the first leader of the Know Nothing Party.

The Know-Nothing Party, also known as the American Party, was a prominent United States political party during the late 1840s and the early 1850s.

The American Party originated in 1849. Its members strongly opposed immigrants and followers of the Catholic Church. The majority of white Americans followed Protestant faiths. Many of these people feared Catholics because members of this faith followed the teachings of the Pope. The Know-Nothings feared that the Catholics were more loyal to the Pope than to the United States. More radical members of the Know-Nothing Party believed that the Catholics intended to take over the United States of America. The Catholics would then place the nation under the Pope’s rule. The Know-Nothing Party intended to prevent Catholics and immigrants from being elected to political offices. Its members also hoped to deny these people jobs in the private sector, arguing that the nation’s business owners needed to employ true Americans.

The Know Nothing Party reshaped American politics so much that it is still felt today.

Like Fight Club, there were rules about joining the secret society known as the Order of the Star Spangled Banner (OSSB). An initiation rite called “Seeing Sam.” The memorization of passwords and hand signs. A solemn pledge never to betray the order. A pureblooded pedigree of Protestant Anglo-Saxon stock and the rejection of all Catholics. And above all, members of the secret society weren’t allowed to talk about the secret society. If asked anything by outsiders, they would respond with, “I know nothing.”

So went the rules of this secret fraternity that rose to prominence in 1853 and transformed into the powerful political party known as the Know Nothings. At its height in the 1850s, the Know Nothing party, originally called the American Party, included more than 100 elected congressmen, eight governors, a controlling share of half-a-dozen state legislatures from Massachusetts to California, and thousands of local politicians. Party members supported deportation of foreign beggars and criminals; a 21-year naturalization period for immigrants; mandatory Bible reading in schools; and the elimination of all Catholics from public office. They wanted to restore their vision of what America should look like with temperance, Protestantism, self-reliance, with American nationality and work ethic enshrined as the nation’s highest values.
