Boeing Dodges A Bullet

After hundreds of deaths, shoddy safety measures, lousy construction and let’s not forget the whistleblowers that mysteriously dead after coming forward, Boeing was set to face a trial for their actions or are they?

Last week federal prosecutors recommended the Justice Department bring criminal charges against Boeing over its failure to keep the terms of an agreement sparing the company from legal action in 737 Max crashes that killed a combined 346 people. A lawyer for the families of those crash victims say what’s in the works is a “sweetheart plea deal.”

Reuters reports the DOJ plans to criminally charge Boeing, with sources saying the company can go to trial or take the deal, which is said to include a $487.2 million fine (Boeing would be credited for a previous settlement and only pay half) and the assignment of an independent monitor to audit the company’s safety practices for a three-year period. The DOJ is said to have briefed victims’ relatives on Sunday. More:

  • Standout lines: “The memory of 346 innocents killed by Boeing demands more justice than this,” victims’ lawyer Paul Cassell tells the BBC, saying the “families will strenuously object to this plea deal.” He adds, “The deal will not acknowledge, in any way, that Boeing’s crime killed 346 people. It also appears to rest on the idea that Boeing did not harm any victim.”
  • What the families want: Per a letter Cassell sent to the DOJ in June, the families of victims of the October 2018 Lion Air and March 2019 Ethiopian Airlines crashes wanted to see Boeing’s then-top executives prosecuted and a $24.8 billion fine levied.
  • Next steps: USA Today reports that should Boeing accept the plea offer, US District Judge Reed O’Connor of Texas will be the one to decide whether to accept the plea agreement in the public interest. Lawyers say victims’ families plan to fly in from around the world to attend any hearing and voice their opposition.
  • The timeline: CNN explains that the DOJ in June let Boeing know that the safety failures it has racked up lately put the company in breach of the 2021 agreement through which Boeing avoided criminal charges (specifically, criminal conspiracy charge to commit fraud) related to the 737 Max crashes. The DOJ said that meant Boeing is subject to criminal prosecution, but it had not announced whether it planned to prosecute the case. The DOJ has a July 7 deadline to file charges, so Boeing will have until week’s end to decide whether to accept the plea deal.
  • Side note: Reuters reports it’s atypical for the DOJ to loop in third parties (in this case, the victims’ families) about its plans prior to alerting the company it intends to charge. Reuters sees the shift as a reaction to the relatives’ outcry over the original 2021 agreement, which they learned about after it had been reached.
  • The anger: The Guardian reports that “on a conference call on Sunday, one official is said to have been asked by a family member how he sleeps at night.”

You realize this will go to the Supreme Court and we know how that will work out with the political hacks on the court, right?

A New Domestic Terrorism Unit

With all the chaos that is being created in this country by the far Right extremists the DOJ has put together a new domestic terrorism unit……

The Department of Justice is opening a new unit to investigate acts of domestic terrorism, a top national security official said during a Senate committee hearing Tuesday.

Why it matters: The FBI and Justice Department warned repeatedly last year that the threat of and investigations into acts of domestic terrorism have increased since 2020.

  • While there is no specific federal domestic terrorism statute, the federal government defines domestic terrorism as criminal acts dangerous to human life that appear to be intended to intimidate or coerce civilians or the policy of a government. It can also use other criminal charges when pursuing domestic terrorists.
  • Lawmakers and active and former FBI agents have called for the creation of a specific statute to make such acts a federal crime, though others have argued it would be redundant or fear it could be used to crackdown on constitutional acts of political dissent.

I mean there has been the violent fringe for many decades and it just kept getting worse and yet no one was focusing on these slugs of society?

For me that does not say much positive for the record of the DOJ….they seem to focus more on white collar crime more than the pigs that want to destroy our government.

The DOJ has always had serious lack of foresight…they are always reacting instead of heading violence off at the pass.

I am glad that someone finally woke up and came to the conclusion that we have a major problem with domestic terrorism….now we will see just how serious they are at preventing stuff like 06 January.

Personally I am not impressed by the announcement…..

The Fight For Voter Rights Heats Up

Most of us know of the voting laws that 48 states are trying to enact……and now the DOJ has stepped up to act as the legal voice of the nation….it begins with the voting laws in the state of Georgia.

The Justice Department is suing Georgia over the state’s voting laws, per the AP. The decision, to be announced later Friday by Attorney General Merrick Garland, comes two weeks after Garland said the Justice Department would scrutinize a wave of new laws in Republican-controlled states that tighten voting rules. He pledged to take action if prosecutors found unlawful activity. The move also comes as pressure grows on the Biden administration to respond to GOP-backed laws being pushed in the states this year. An effort to overhaul election laws was blocked this week by Republican senators. As of mid-May, 22 restrictive laws had passed in at least 14 states, according to the Brennan Center for Justice, which researches voting and supports expanded access.

While much of the more controversial aspects of Georgia’s new voting law were dropped before it was passed, it is notable in its scope and for newly expansive powers granted to the state over local election offices. Under the bill, the GOP-dominated legislature gave itself greater influence over a state board that regulates elections and empowered that board to remove local election officials deemed to be underperforming. That has raised concerns that the state board could intervene in the operations of Democratic-run county election offices in metro Atlanta, the state’s Democratic power center. The bill also adds a voter ID requirement for mail ballots and will result in fewer ballot drop boxes in metro Atlanta.

These laws should be challenged because they are an assault on the right of every American.

Let the others follow suit (no pun intended)ma and take on these laws that are trying to lessen the democratic process in most states.

Finally Trump’s lawyer at the DOJ, AG Bill Barr has been called out by a couple of judges for his part in the obfuscating of the investigation conducted by Mueller…..

A federal judge has ordered the release of a legal memorandum the Trump-era Justice Department prepared for then-Attorney General William Barr before he announced his conclusion that then-President Trump had not obstructed justice during the Russia investigation, the AP reports. The Justice Department had refused to give the March 24, 2019, memorandum to a government transparency group that requested it under the Freedom of Information Act, saying the document represented the private advice of lawyers and was produced before any formal decision had been made and was therefore exempt from disclosure under public records law. But US District Judge Amy Berman Jackson, in a sharp rebuke of Barr, said the Justice Department had obscured “the true purpose of the memorandum” when it withheld the document.

She said the memo from the Justice Department’s Office of Legal Counsel contained “strategic, as opposed to legal advice” and that both the writers and the recipients already understood that Trump would not be prosecuted. Though government agencies may withhold from disclosure documents that reflect internal deliberations before a decision is made, that protection does not apply in this case since a conclusion had already been reached, the judge wrote. “In other words, the review of the document reveals that the Attorney General was not then engaged in making a decision about whether the President should be charged with obstruction of justice; the fact that he would not be prosecuted was a given,” Jackson said in an order dated Monday. The judge said the Justice Department has until May 17 to file any motion to stay the order.

Will this sycophant that covered Trump’s ass for years finally be exposed for the dullard he truly is and made to be accountable for the lies and misinformation that was the hallmark of Trump and his administration.

Spotlight On Giuliani

I have never thought Rudy was all that even in the shadow of the Towers on 9/11….and my dislike only grew…..through his failed presidential fiasco and through the Trump years where to me he sounded like a babbling moron I always thought he was.

Now the DOJ has raided Rudy’s office on his dealings with Ukraine…apparently something may be a bit hinkey with his dealings…..

Federal investigators from the office Rudy Giuliani used to lead searched the former New York City mayor’s Manhattan apartment and Park Avenue office early Wednesday, sources tell numerous outlets. Insiders tell the New York Times that Giuliani’s electronic devices were seized in connection with an investigation of his dealings in Ukraine. Sources tell the Times and AP that the United States Attorney’s office in Manhattan, which Giuliani led from 1983 to 1989, pushed for a search warrant last year but the Justice Department under former President Trump refused to sign off on it. The AP reports that in doing so now, prosecutors are indicating they have probable cause that Giuliani committed a federal crime; that does not mean he will be charged. The Times calls it “an extraordinary move for prosecutors to take against a lawyer, let alone a lawyer for a former president.”

Giuliani lawyer Roberto Costello confirmed the searches to the Times, calling them unnecessary and “legal thuggery.” Giuliani has not been charged and he has denied wrongdoing, CNN reports. He hasn’t commented on the Wednesday search yet, but he has previously described the investigation as “pure political persecution.” The Times reports that investigators have been focusing on whether Giuliani illegally lobbied for the administration on behalf of Ukrainian oligarchs. Giuliani has longstanding connections in Ukraine and worked on behalf of Trump to try to dig up damaging information on President Biden and his son, Hunter. Two Soviet-born men who aided Giuliani’s investigation were arrested in the US in 2019 on campaign finance charges. Politico reports that investigators suspect Giuliani was paid for his efforts to persuade Trump to oust US Ambassador Marie Yovanovitch.

Make Them Pay!

I have made my thoughts known on how I feel the insurrectionists should be handled….but it never hurts to be redundant.

The Justice Department is tracking down the participants in the insurrection of 06 January…..my thoughts are make the bastards pay for their actions….

Looks like the charge of sedition is in the works for those low IQ parasites on our republic….

Sedition charges could very well be leveled against some suspects in the Jan. 6 attack on the US Capitol, according to the federal prosecutor who led the Justice Department’s probe into the riot until recently. Michael R. Sherwin spoke to 60 Minutes Sunday, as reported by the New York Times, the Washington Post, and Reuters. “I personally believe the evidence is trending toward that, and probably meets those elements,” Sherwin said of sedition, or conspiring to overthrow the government. The DoJ does not often bring such a charge, but Sherwin said the evidence gathered so far seems likely to meet the bar, for at least some suspects. “I believe the facts do support those charges. And I think that, as we go forward, more facts will support that,” he said. Sherwin has promised to pursue sedition charges since first announcing a task force to probe the attack.

The federal government last brought sedition charges in 2010, against members of a Michigan militia who were ultimately acquitted. Sedition charges can be used against people who forcefully attempt “to prevent, hinder or delay the execution of any law of the United States,” and prosecutors have accused some Capitol suspects of trying to put a stop to the electoral college certification process. More than 400 people have so far been charged, hundreds of them with trespassing, more than 100 with assaulting officers, and a handful (including members of groups including Proud Boys and Oath Keepers) with conspiracy to obstruct Congress. Sherwin, the former acting US attorney in Washington, says just about 10% of the cases so far involve far-right conspiracies and schemes. Sherwin, who witnessed the violence himself, stepped down from leading the probe Friday.

Insurrection Good News/Bad News

The saga continues for the insurrection of 06 January 2021……the FBI and Justice Department is trying to find those that participated and bring them to justice…..

The good news of the insurrection……more arrests coming…..

The U.S. Justice Department on Friday said it expects to file criminal charges against more than 100 additional people who allegedly participated in the Jan. 6 attack on the U.S. Capitol, in what it described as probably the most complex investigation it has ever handled.

More than 300 people already face charges stemming from the siege, which left five people dead and more than 130 police officers injured as thousands of supporters of former President Donald Trump tried to prevent Congress from certifying his election defeat.

Sadly there is bad news as well…..

The US attorney’s office in Washington, DC, expects to start offering plea deals to people charged in the Capitol insurrection in the next 30 days, a prosecutor told a judge on Friday.

None of the 300-plus people charged with participating in the Jan. 6 riot at the Capitol have pleaded guilty to charges so far. Court filings in recent weeks have confirmed that some defendants are open to cutting a deal, but until now prosecutors had been vague about timing, at least in their public representations about the investigation. They’ve told judges that because of the mountain of evidence they’re still gathering and sifting through, they needed more time before they could make offers.

During a Friday morning hearing in the case of two alleged Capitol rioters, Jenny Cudd and Eliel Rosa, Assistant US Attorney Amanda Fretto said that based on information prosecutors had received from supervisors, it sounded “like things are moving along.” Fretto said she had spoken with lawyers for Cudd and Rosa about agreeing to suspend deadlines in their case for 30 days to give the government time to extend a plea offer.

There has been protests going on all over this nation and it has been met with the fascistic force of the police with the encouragement of the DoJ……now they (DoJ) has decided that some of our major cities are to be called “terrorists” or better yet “Anarchists Jurisdictions”……..

The Justice Department identified New York City; Portland, Ore.; and Seattle as three cities that could have federal funding slashed under a memorandum by President Trump that sought to identify localities that permit “anarchy, violence and destruction in American cities.” The designation, which could open the door for the federal government to cut off some funding to the cities, drew immediate criticism from local elected officials. It comes as Trump throughout the summer has cast American cities run by Democratic mayors as under siege by violence and lawlessness, despite the fact that most of the demonstrations against racial injustice have been largely peaceful. An attempt to cut off federal funding to the cities would likely be met with immediate legal challenges and several federal judges ruled in favor of municipalities over similar attempts to withhold funding tied to immigration policies.

The Justice Department said the three cities were designated because they meet four main criteria, including “whether a jurisdiction forbids the police force from intervening to restore order amid widespread or sustained violence or destruction” and whether the city “disempowers or defunds police departments.” Attorney General William Barr said he hoped the designation would convince the cities to “reverse course and become serious about performing the basic function of government and start protecting their own citizens.” In a joint statement, New York City Mayor Bill de Blasio, Portland Mayor Ted Wheeler, and Seattle Mayor Jenny Durkan decried the designation as “thoroughly political and unconstitutional.”

When I write about the threat of white supremacist terrorism, I often receive complaints from readers that I am focusing on the wrong problem and that my articles are ill-informed and misleading (I’m putting the complaints politely). Instead of focusing on white supremacists, they argue, I should instead write about the “real” terrorists like antifa and Black Lives Matter.

Their opinions are backed up by statements from the police and Trump administration officials and images of burning cities. A big win for President Trump: The Justice Department said Thursday it is dropping the criminal case against Michael Flynn, per the AP. The case involving Trump’s first national security adviser had become a rallying cry for the president and his supporters in attacking the FBI’s Russia investigation. The move is a stunning reversal for one of the signature cases brought by special counsel Robert Mueller. It comes even though prosecutors for the last three years had maintained that Flynn had lied to the FBI about his conversations with the Russian ambassador in a January 2017 interview. Flynn himself admitted as much, and became a key cooperator for Mueller as he investigated ties between Russia and the 2016 Trump campaign.

In court documents being filed Thursday, the Justice Department said it is dropping the case “after a considered review of all the facts and circumstances of this case, including newly discovered and disclosed information.” The Justice Department said it had concluded that Flynn’s interview by the FBI was “untethered to, and unjustified by, the FBI’s counterintelligence investigation into Mr. Flynn” and that the interview on January 24, 2017, was “conducted without any legitimate investigative basis.” The US attorney reviewing the Flynn case, Jeff Jensen, recommended the move to Attorney General William Barr last week and formalized the recommendation in a document this week. The decision is certain to be embraced by Trump, but it will likely add to Democratic concerns that Attorney General William Barr is excessively loyal to the president.

This illustrates that if you kneel before the god of idiocy enough you can get away with any crime you choose.
