Rebuke Of Title IX

This is one of those issues that should be a major point of contention after 20 January……LGBTQ+ issues…..most of us know how the states feel about these situations….and Biden attempted to try an end run….

A judge has made his pronouncement on the law…..

The Biden administration’s Title IX rules expanding protections for LGBTQ+ students have been struck down nationwide after a federal judge in Kentucky found they overstepped the president’s authority. In a decision issued Thursday, US District Judge Danny C. Reeves scrapped the entire 1,500-page regulation after deciding it was “fatally” tainted by legal shortcomings. The rule had already been halted in 26 states after a wave of legal challenges by Republican-run states. President-elect Trump previously promised to end the rules “on day one” and made anti-transgender themes a centerpiece of his campaign.

  • The decision came in response to a lawsuit filed by Tennessee, Kentucky, Indiana, Ohio, Virginia, and West Virginia. Tennessee Attorney General Jonathan Skrmetti called it a rejection of the Biden administration’s “relentless push to impose a radical gender ideology,” the AP reports. “Because the Biden rule is vacated altogether, President Trump will be free to take a fresh look at our Title IX regulations when he returns to office,” Skrmetti said in a statement.
  • The Biden administration ignited controversy when it finalized the new rules last year. The regulation expanded Title IX, a 1972 law prohibiting discrimination based on sex in education, to also prevent discrimination based on gender identity or sexual orientation. It also widened the definition of harassment to include a greater range of misconduct.
  • Civil rights advocates hailed the move as a victory, saying it gave LGBTQ+ students new recourse against discrimination. But it drew outrage from conservatives who said it could be used to protect transgender athletes in girls’ sports. The rule didn’t explicitly address athletics and mostly detailed how schools and colleges were required to respond to cases of discrimination and sexual assault.
  • In his decision, Reeves found the Education Department overstepped its authority by expanding the scope of Title IX. There’s nothing in the 1972 law suggesting that it should cover any more than it has since Congress created it, Reeves wrote. He called it an “attempt to bypass the legislative process and completely transform Title IX.”
  • Rather than carve out certain aspects of the rule, Reeves decided it was better to toss the regulation in its entirety and revert to a previous interpretation of Title IX. He said his decision will “simply ’cause a return to the status quo’ that existed for more than 50 years prior to its effective date.”

I am sure when this is revisited that the Trump admin will just pass it off to the states….it is not something Donald the Orange wants to deal with over his Big Mac.

How will the Dems handle this issue will be telling.

Biden’s First 100 Days

Joe Biden has been in office at his job for 100 days….IST would like to take a look at those first days…..

I did not vote for Biden but I will say that so far I approve of his attempts….but that does not mean these policies will become the law of the land.

What has Biden been doing for these first days of his administration….

Great numbers for his first 100 days….

Let’s take a look at the Biden agenda….

  • end the pandemic and ensure the success of the vaccination program–this is progressing nicely over 250 million pokes have been administered….and the nation is coming out of their masks slowly but securely.

  • full recovery and jobs growth for the economy…the economy is doing well and job growth is slow but steady7.

  • racial justice and voting rights….this is in progress but I am not optimistic whatsoever.

  • climate change and green energy job creation….a work in progress but another policy that I fear will not go anywhere.

  • completing Obamacare and ensuring access to a “public option” for health insurance coverage…this does little but make the health industry make obscene profits at the expense of Americans.

  • immigration reform and a path to citizenship for the “Dreamers”….slow progress but the border is a mess that needs a solution.

  • “Build back better” America’s infrastructure: roads, bridges, railroads, airports, electricity grids, water supplies….a great idea but has push back from Repubs and Manchin and Sinema both Dems…..so this will be little help for our aging infrastructure.

  • gun control……minor teaks is the best he will do from this day forward.

Biden has called for “unity”….this is laughable at best…..not one Repub has signed on the assistance to Americans instead they hold with voter fraud, voter suppression, gender stuff and all around silliness that does NOTHING for the nation.

After 100 days what can the GOP claiming as successes?

Long Pause……distinct sound of crickets….

The only thing the GOP can claim is that they are obstructing the democratic process….they are voting for NOTHING…they offer no compromise for needed legislation….

So how did Biden do in his first 100 days?

I give him an “A” for the efforts he is attempting……I will also give him an “A” on style……however so far I give him a “C+” to  accomplishment….

Now that I have given Biden his props let me say that he needs to do so much more…..my thought is “Go Big Or Go Home”.

Finally after months of silly Trump antics and the GOP congressional sycophants and the violence committed by Trump protesters because the unthinkable happen he lost….has been for naught.

The count is finally finished in the wee hours of Thursday morning….but not without antics….

A small group of House lawmakers came close to physically fighting early Thursday morning as the congressional count of electoral votes stretched into the wee hours and a Pennsylvania Democrat charged that Republicans had been telling “lies” about his state’s votes, the AP reports. Rep. Morgan Griffiths, R-Va., objected after Rep. Conor Lamb, D-Pa., said a breach of the Capitol by an angry mob earlier in the day was “inspired by lies, the same lies you are hearing in this room tonight.” House Speaker Nancy Pelosi shot down the objection, but a few minutes later Republicans and Democrats streamed to the middle aisle, with around a dozen lawmakers getting close to each other and arguing. But the group quickly broke up when Pelosi called for order on the floor.

Meanwhile, the Senate quickly killed Republican objections to Pennsylvania’s electoral vote for President-elect Joe Biden, and the House was preparing to vote at the time of this posting. The electoral vote count stood at 244 for Biden and 157 for Trump as of this posting. Pennsylvania would give Biden 20 more. CNN is posting live updates here.

It is now finally official!

It’s done: Congress certified Joe Biden’s presidential election in the wee hours of Thursday, after the electoral vote count was interrupted Wednesday by a pro-Trump mob that breached the Capitol building, CNN reports. More than half of the lawmakers who originally planned to challenge Biden’s electoral wins in certain states ultimately reversed course after the riot, the AP reports, and all the objections that were raised were voted down. The certification came 15 hours after the session began.

Update to previous post….the woman shot in the Capitol has been identified…..

The woman fatally shot as rioters stormed the Capitol Wednesday has been identified by relatives as Ashli Babbit, a 35-year-old San Diego resident. Her husband tells KUSI that Babbit was a four-term Air Force veteran and a “strong supporter of President Trump.” DC Police Chief Robert Contee says the woman was shot by a Capitol Police officer as rioters tried to break into the House chamber, WUSA-9 reports. “This is a tragic incident,” Contee says. “And I send my condolences to the victim’s family and friends.” Social media postings suggest Babbit supported the QAnon conspiracy theory.

Video of the shooting shows that the woman was shot after rioters smashed the glass at the top of barricaded doors to corridor leading to the House chamber, the San Diego Union-Tribune reports. “We had stormed into the chambers inside. And there was a young lady who rushed through the windows,” a witness told WUSA-9. “A number of police and Secret Service were saying get back, get down, get out of the way. She didn’t heed the call and as we kind of raced of raced up to grab people and pull them back, they shot her in the neck.” She died after being hospitalized in critical condition. Contee says three other people died after suffering “medical emergencies” during the breach, the AP reports.

I have been waiting for those Trump supporters here on IST to come and condemn these actions from the protesters…..so far the sound of crickets…..
