Looks like today is going to be a day that I post on legal stuff. The SCOTUS is handed down their rulings and I cannot see any surprises in their findings…..how about you?
First, our cel phones are considered holy and cannot be searched for minor infractions…..but of course the word…”TERRORISM” can be used and all bets are off.
I wrote about Boehner’s plan earlier……he’s gonna sue the Prez over executive orders……
If the following post is any indication of the court’s feelings on the matter then the ruling over EO should be NO surprise either when it comes down……..
The Supreme Court has just limited a president’s power to make temporary appointments to fill high-level government jobs. The court ruled today that President Obama exceeded his authority when he invoked the Constitution’s provision on recess appointments to fill slots on the National Labor Relations Board in 2012. Problem is, the court said, the Senate was not actually in a formal recess when Obama acted. In the court’s first-ever look at the Constitution’s recess appointments clause, the justices ruled that Congress gets to decide when it is in recess and that there was no recess when Obama acted.
Obama had argued that the Senate was on an extended holiday break and that the brief sessions it held every three days were a sham that was intended to prevent him from filling seats on the NLRB. The justices rejected that argument, but the outcome was the least significant loss possible for the administration. The justices, by a 5-4 vote, rejected a sweeping lower court ruling against the administration that would have made it virtually impossible for any future president to make recess appointments. The lower court held that the only recess recognized by the Constitution is the once-a-year break between sessions of Congress, and that only vacancies that came up during that recess could be filled.
Surprise! Did anyone really think that there would be any other ruling from the Robert’s Court?
Do the GOP morons realize that if they find in their favor that they could be peeing all over the next GOP prez? Blind hatred makes men stupid and losing two elections to a black Dem have made GOPers “blind ass stupid”!
All I can say to you is if we take the Sen. and act like Reid what are you going to say? After watching Obama at a fund raiser, he didn’t even believe his own words that all the scandals are phony. I do believe that there will be some Dem. voters that are smart enough to see the real Obama. The Dems. need to put him in the closet because he is sinking your ship.
these are all wastes of time…if they want to take the Senate then maybe focusing on issues that effect people would be a better lace to start…….
I think raising the gas tax is aimed at the very poor. This isn’t the time to strap them with another tax. We have so many problems and only a few in the Congress will do what it takes and the hell with party lines. I hate all the pandering that goes on on all sides. It just seems that people are tired of the whole govt. maybe we should just shut DC down. It is sickening to see what some govt. workers have done and they still have a job! It is all very disgusting to me. I’m going back to the Food Nazi!
Hi muse….I agree with you about the government….the problem is as tired as we ar we will re-elect about 80% of them….nothing will change until we get away from this party BS…..
The Supreme Court just completed the constitutional circle-jerk. The Senate didn’t want to its job and vote on presidential appointments. So they come up a BS way to leave town but claim they are not in recess to prevent the president from using his clearly constitutional power to do recess appointments. The constitution doesn’t define what constitutes a “recess” so the president calls their bluff on a fake proforma session every 3 days. Finally the Senate changes their rules so that presidential nominees can get a straight up or down vote but the now mute lawsuit moves forward anyway. Then our “brilliant” court decides that 3 days isn’t a recess but 10 days is a recess. Exactly where in the constitution does it say the Supreme Court gets to decide 3 is not enough but 10 is, and where does it say they get to establish a Senate rule? The Congress is totally dysfunctional and the Supreme Court is out of control which leaves the president playing with himself.
Hi Daniel…..I agree totally……
